Po téměř pěti letech policejního vyšetřování zahájí soudce pražského městského soudu Dušan Paška proces, v němž Železnému teoreticky hrozí až dvanáct let vězení za celní únik při dovozu obrazů.
Doposud Železného případy "komplikovala" právě jeho politická kariéra. Už dvakrát musel stát žádat o to, aby byl zbaven imunity. Poprvé, když se stal v roce 2002 senátorem, podruhé poté, co byl loni zvolen europoslancem.

The founder and ousted long-time director of the Czech commercial TV station Nova (the bigger of the two privately-owned terrestrial broadcasters operating in the Czech Republic) turned politician in 2002 is finally to stand trial at the end of one of several investigations into his affairs that have been going on for almost five years. He faces up to 12 years in jail on tax-evasion charges. The judicial process has been made more difficult by his entry into politics, first as a senator and later member of the EU parliament. Czech members of parliament enjoy significant protections against prosecution which can only be rescinded by a vote of their peers which is only rarely forthcoming. Some have argued that Železný ran for parliament partly to protect himself from a potential judgement against him.
